NATO MAY Face War Crimes Probe, Some Claim to Worry

According to a report by the Associated Press (11 November) some NATO diplomats are worried that the alliance may be investigated by the International Criminal Court (ICC) after its prosecutor said allegations of crimes committed by NATO in Libya would be examined "impartially and independently".

The NATO diplomats speaking anonymously said action to pre-empt a war crimes investigation would likely include an immediate internal legal review of all incidents in which NATO bombing or other actions caused civilian casualties.

NATO Secretary General Anders Fogh Rasmussen even refuses to acknowledge that were any civilian deaths caused by the bombing. During his monthly press briefing on 3 November, he said:

As regards collateral damage, I have to say that we conducted our operations in Libya in a very careful manner, so we have no confirmed civilian casualties caused by NATO

Casualties, by the way, includes injuries as well as deaths, technically. I do have to say, I imagine you can't fail to confirm a single one of the thousands of civilians they killed, especially in Sirte, without treating the facts and common sense in any other than "a very careful manner."

Chances any NATO country's leader will be handed over for war crimes against humanity trials, or stabbed in the ass and shot dead before even getting the chance?

  1. Yes, that's as good a list, from Libya S.O.S. and al4 Peace, that I could find. As far as I can tell, no one's done anything more comprehensive, morebalanced, or remotely complete. Hardly a single case was documented in a way most here would accept, and it's all just an incrediblefudge-zone. Could be anywhere up to 10, 20, 30,000 non-combattants and we'dbe left thinking somewhere between zero and a few dozen, maybe.

    That should be a war crime. Like dropping real bombs from within a cartoon control room of filtered rose-colored-glasses assessments. Really, driving through a neighborhood shooting a tank without looking, just telling yourself "that's ten more Glork invaders and no bystanders!" is no defense.

    Not to mention that the supposed reasons that required violence against "legitimate" targets also seems to not exist.I move the term war crime be removed from the list. It has no meaning anymore,except when used backwards to promote injustice.

  2. Causing civilian deaths is not the crime the ICC should be concentrating on. The real crime of Nato and its political leadership is "participation in a common plan or conspiracy for the accomplishment of a crime against peace." The UN "no-fly zone" fig leaf will not save Sarko & co as the crime was committed well before any UN SC resolution.

  3. Well put, Petri. It'seasy to loose track when the bar regarding NATO crimes is set so... is there a bar?

    Googling that phrase (I had to), it's got a precedent at Nuremberg, and it fits the facts of this case as well. Not the established facts, of course, which presuppose the peace already broken. And it was, just by the side we insisted on protecting while punishing, quite literally, the victim.

    But either way,and"conspiracy"will always be debatable and dismissable, civilian targeting, which repeated hitting of civilians and their necessities would indicate, is very important. Total War is too powerful a tool of evil to where it's pretty well outlawed now. It's cheating, big time, with huge ramifications. But we saw that in spectacular form in Sirte, and more diffuse against Libya in whole. No tolerance, respect, decency, or normalcy required for some unclear reason. Gaddafi's alleged eveil had all the stops pulled out, and even then our clients were complaining that we were pansies. Cut off all supplies,destroy water reserves, pound them to hell, make them all know it's surrender or death... Or often surrender then death, maybe with torture in between...

    yeah, that kind of cheating was ALLEGED against Gaddafi, kind of done in Misrata over many months, but knocked outta the ballpark by NATO and their Terrorist Collaborators in just a few weeks against smashed Sirte - a city of 75,000,with 22,000 fled/surrendered before the team called it clear and started really pounding. And still NATO claims no casualties.

    That should be a huge crime, because their lies have a way of becoming legal reality, and leave them self-immunized against all counter-suits as they gang-rape nations, blame the victim, leave them the bill, and collect aggressively.

    Sorry, bit of a rant with no new information really...

    International Development Secretary Andrew Mitchell told Sky News that the reports from the hospital were "appalling".

    "We will hold to account anyone, on either side, who commits atrocities," he said.
    Mr Mitchell said that the International Criminal Court would be the correct place for dealing with those accused of war crimes.

  10. As was documented at the time, NATO provided air cover for the attack on Tawergha and must have been aware of the genocidal intent of the rebel leaders which was reported, previous to the assault on the town, in the Wall Street Journal.

"Russia has asked for the Security Council to undertake an evaluation of protection of civilians, because Resolution 1973 is about protecting civilians," Puri said. "So what kind of damage was there, collateral damage to civilians, etc? There is great reluctance to undertake that."

    A report by independent Arab human-rights groups in January 2012 and a report by the UN Human Rights Council (March 2, 2012) have been largely ignored. Both showed that the proposition that Muammar Gaddafi's forces were conducting genocide was grossly exaggerated, and both called for an open investigation of NATO's aerial bombardment.

    Puri indicates that the NATO states in the Security Council have not warmed up to the idea of an evaluation. When the Human Rights Council began its investigations, NATO's legal adviser Peter Olson wrote a sharp letter to the commission's chair:
    We would be concerned if "NATO incidents" were included in the commission's report as on a par with those which the commission may ultimately conclude did violate law or constitute crimes. We note in this regard that the commission's mandate is to discuss "the facts and circumstance of ... violations [of law] and ... crimes perpetrated". We would accordingly request that, in the event the commission elects to include a discussion of NATO actions in Libya, its report clearly state that NATO did not deliberately target civilians and did not commit war crimes in Libya.

Crooks. Pillai:The Libyan uprising began on February 15, 2011. By February 22, the UN Human Rights Chief Navi Pillay claimed that two hundred and fifty people had been killed in Libya, “although the actual numbers are difficult to verify.” i.e. massively inflated.
